Agreement to Terms
By accessing or using Sipfluence ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
Sipfluence is operated in the Philippines and these Terms are governed by Philippine law.
Who Can Use Sipfluence
- You must be at least 16 years old to create an account
- Cafe accounts must represent a legitimate food or beverage business operating in the Philippines
- Creator accounts must represent real individuals with active social media profiles
- You must provide accurate and truthful information during signup
- You are responsible for maintaining the security of your account
How the Platform Works
Sipfluence connects cafe owners with food content creators for collaboration purposes. The Platform facilitates:
- Barter collaborations: cafes offer free food or drinks in exchange for social media content from creators
- Paid collaborations: cafes pay creators a fee for content creation, as agreed between both parties
Sipfluence is a matchmaking platform. We are not a party to any agreement between cafes and creators. All terms of a collaboration (what is offered, what content is expected, timelines, payment amounts) are agreed upon directly between the cafe and the creator.
Cafe Responsibilities
- Honor the terms of your collab listings (if you offer a free meal, provide it when the creator visits)
- Treat creators with respect and professionalism
- Do not post misleading listings or misrepresent your business
- Respond to creator applications in a timely manner
- If offering paid collabs, pay creators the agreed amount within the agreed timeframe
Creator Responsibilities
- Deliver the content you agreed to (number of posts, stories, reels, etc.) within the agreed timeline
- Create honest, authentic content about your experience
- Do not accept a collab and then fail to show up or post
- Do not use fake followers, bots, or engagement manipulation
- Disclose the collaboration as required by Philippine advertising standards
Content Ownership & Usage
- Creator content: creators retain ownership of the content they create. By posting content as part of a collab, creators grant the cafe a non-exclusive, royalty-free license to repost the content on their own social media channels with proper credit
- Profile content: by creating a profile on Sipfluence, you grant us permission to display your profile information on the Platform
- Sipfluence content: all Platform content (design, text, graphics, logos) is owned by Sipfluence and may not be copied or used without permission
Pricing & Payments
- Sipfluence is free for creators. Always.
- Cafes can use the Free plan at no cost. The Premium plan is ₱499/month and can be cancelled anytime.
- Sipfluence does not take any commission from paid collaborations between cafes and creators
- Payment disputes between cafes and creators should be resolved directly between the parties. Sipfluence may assist in mediation but is not liable for payment disputes.
Prohibited Conduct
You agree not to:
- Use the Platform for any illegal purpose
- Harass, threaten, or abuse other users
- Post false, misleading, or defamatory content
- Create multiple accounts or impersonate another person or business
- Scrape, harvest, or collect user data from the Platform
- Attempt to bypass or interfere with the Platform's security features
- Use the Platform to promote products, services, or content unrelated to cafe-creator collaborations
Account Suspension & Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if we determine your use of the Platform is harmful to other users. We will attempt to notify you before taking action, except in cases requiring immediate action.
You may delete your account at any time by contacting us at hello@sipfluence.ph.
Limitation of Liability
Sipfluence is provided "as is" without warranties of any kind. We are not liable for:
- The quality of collaborations between cafes and creators
- Any losses resulting from the actions of other users
- Service interruptions, data loss, or technical issues
- Any indirect, incidental, or consequential damages
Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Sipfluence in the 12 months preceding the claim, or ₱5,000, whichever is less.
Dispute Resolution
Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be settled through arbitration in accordance with Philippine law, with proceedings conducted in Cebu City, Philippines.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
